Please read these terms carefully before using the Sarvgenic AI platform. By accessing our services, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Sarvgenic platform, including the website (sarvgenic.com), web application (app.sarvgenic.com), APIs, AI voice agents, CRM tools, virtual number services, and any related services (collectively, the "Services").

By creating an account, accessing, or using any part of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must meet the following requirements to use the Services:

  • You must be at least 18 years of age
  • You must have the legal authority to enter into a binding agreement
  • If registering on behalf of a business, you must be authorized to bind that entity to these Terms
  • Your use must comply with all applicable local, state, national, and international laws

3. Account Registration

To access certain features, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

Sarvgenic reserves the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent activity.

4. Services Provided

Sarvgenic offers the following core services:

  • CRM Platform — lead management, pipeline tracking, and customer relationship tools
  • Virtual Numbers — Indian virtual phone numbers for call routing, tracking, and management
  • AI Voice Agents — AI-powered voice bots that handle inbound and outbound calls on your behalf
  • Call Recording & Transcription — automatic recording, transcription, and AI-generated call summaries
  • Integrations — connections with Google Ads, Meta Ads, WhatsApp Business, and other platforms

We may modify, add, or discontinue any feature with reasonable notice. Continued use of the Services after changes constitutes acceptance.

5. Acceptable Use

You agree not to use the Services for any of the following:

  • Any unlawful, fraudulent, or harmful purpose
  • Sending spam, unsolicited calls, or bulk messages without proper consent
  • Impersonating any person or entity, or misrepresenting your affiliation
  • Attempting to gain unauthorized access to other accounts, systems, or networks
  • Interfering with or disrupting the integrity or performance of the Services
  • Reverse-engineering, decompiling, or attempting to extract the source code of the platform

Violation of these rules may result in immediate suspension or termination of your account without refund.

6. Billing & Payments

Certain features require a paid subscription or credit-based usage. By subscribing, you agree to:

  • Pay all applicable fees as described on our Pricing page
  • Authorize us to charge your payment method on a recurring basis (if applicable)
  • Understand that credits and usage charges are non-refundable once consumed

6.1 Free Tier

The free tier provides limited access. Usage beyond free limits requires a paid plan or credit purchase.

6.2 Refund Policy

Subscription fees are non-refundable except where required by applicable law. Unused credits do not roll over unless your plan explicitly states otherwise. We reserve the right to modify pricing with 30 days advance notice.

7. Intellectual Property

All content, features, and functionality of the Services — including but not limited to software, design, text, graphics, logos, and AI models — are owned by Sarvgenic and protected by intellectual property laws.

  • You may not copy, reproduce, or distribute any part of the Services without written permission
  • Your data remains yours — we do not claim ownership of content you upload or create through the platform
  • You grant Sarvgenic a limited license to process your data solely for the purpose of providing the Services

8. AI Voice Agent Terms

By using our AI voice agents, you acknowledge and agree:

  • AI agents act on your behalf — you are responsible for the conversations they initiate
  • You must obtain any legally required consent before enabling call recording or AI-powered calls
  • AI-generated responses may not always be 100% accurate — you should verify critical information
  • Sarvgenic is not liable for any business decisions made based solely on AI-generated outputs

Compliance Notice: It is your responsibility to comply with TRAI regulations, TCCCPR guidelines, and any other applicable telecom or privacy laws when using AI voice agents for calling.

9. Data & Privacy

Your use of the Services is also governed by our Privacy Policy. Key points:

  • We process your data on secure, India-based infrastructure
  • We do not sell your personal data to third parties
  • Call recordings and CRM data are encrypted at rest and in transit
  • You may request data deletion at any time via our Data Deletion page

10. Third-Party Services

The Services integrate with third-party platforms (e.g., Google, Meta, WhatsApp, payment gateways). When using integrations:

  • You are also subject to the third party's terms and privacy policies
  • Sarvgenic is not responsible for third-party service outages, data handling, or policy changes
  • We access only the data necessary to provide the integration functionality

11. Service Availability

We strive for high uptime but do not guarantee uninterrupted availability. The Services may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Unexpected outages or technical issues
  • Factors beyond our control (e.g., third-party provider downtime, natural disasters)

We are not liable for any loss or damage resulting from service interruptions.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Sarvgenic shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim arising from the Services shall not exceed the amount you paid in the preceding 12 months
  • The Services are provided "as is" and "as available" without warranties of any kind, express or implied

13. Termination

Either party may terminate the agreement:

  • You — may cancel your account at any time from your dashboard or by contacting support
  • Sarvgenic — may suspend or terminate accounts that violate these Terms, with or without notice

Upon termination:

  • Your access to the Services will be revoked
  • Data will be retained for 90 days, after which it will be permanently deleted
  • Outstanding payments remain due and payable

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Services shall be resolved through:

  • Negotiation — both parties will first attempt to resolve disputes amicably
  • Arbitration — if negotiation fails, disputes will be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996
  • Jurisdiction — the courts of New Delhi, India shall have exclusive jurisdiction

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. We will provide reasonable notice (via email or in-app notification) for material changes. Continued use of the Services after changes constitutes acceptance of the revised Terms.
